Distance Sales Agreement

BUYER / CONSUMER: The natural or legal person who is a member of the bunayorumum.net platform and purchases one of the services listed below.

Article 2 — Subject of the Agreement

This Agreement governs the rights and obligations of the parties, in accordance with the provisions of the Consumer Protection Law No. 6502 (TKHK) and the Distance Contracts Regulation, regarding the AI-powered car and motorcycle listing analysis services (SaaS), whose characteristics and sale price are specified below, that the Consumer orders electronically via bunayorumum.net.

Article 3 — Service Content and Pricing

The services subject to the Agreement:

  • Plus: a monthly auto-renewing analysis membership, cancellable anytime (access continues to the end of the period after cancellation)
  • Subscription packages: Premium and Dealer (Starter, Pro) plus Enterprise (monthly/annual periods).
  • Wallet analysis packages: balances of 5, 10, 20, 40 analyses (an additional "free balance" may be granted on the first top-up)
  • Premium Expert Review: a detailed expert review for a single car or motorcycle listing (20% discount for Premium users)
  • Gift Card: a prepaid card that can be gifted to another person; its amount is loaded onto the recipient's wallet.
  • Invitation / referral credit: a non-purchased credit granted for promotional purposes; it cannot be converted to cash and is non-refundable.

Current prices are published on the pricing page. Prices include VAT (20%).

Article 4 — Payment Methods

The Buyer may pay the contract price by one of the following methods:

  1. Credit / debit card: available for plan subscriptions and pre-set wallet packages. The checkout page is hosted by Creem, acting as Merchant of Record; card details are processed on that PCI-DSS compliant infrastructure and are never stored on our servers. Charges are made in US dollars (USD) and settle immediately. Card payment is not yet available for gift cards, the Premium Expert Review and custom-amount wallet top-ups.
  2. Bank transfer (Havale / EFT): a bank transfer to the current IBAN and account holder details shown at the payment step (confirmation is performed manually within 1 to 24 hours). The Buyer must enter the order / transaction reference provided to them in the transfer description; transfers whose reference does not match may be confirmed with delay.
  3. Wallet balance: deducted instantly from a previously loaded balance. A custom-amount wallet top-up itself is made by bank transfer.

Payment by methods other than the above (including crypto assets) is not accepted.

Invoice: for card payments, Creem carries out the transaction as the seller of record and provides the Buyer with the payment document under its own tax regime. For bank transfer and wallet balance payments, an e-archive invoice / e-invoice is issued by us and sent to the email address registered in the Buyer's account.

Article 5 — Performance of the Service

The service consists of analyzing a listing link specified by the Buyer with AI and compiling anonymized and aggregate market price data from sources such as sahibinden.com and arabam.com to produce a report, which is then displayed instantly in the Buyer's account.

Following confirmation of the payment by Bunayorumum, the digital service subject to the Agreement is made available for digital access by being instantly assigned to the Buyer's user account, without any physical delivery being required. Pursuant to art. 117 of the Turkish Code of Obligations No. 6098, Bunayorumum is obliged to perform the service instantly.

The report produced is an AI-powered estimate for informational purposes; it does not constitute a binding inspection, valuation, or purchase/sale recommendation. The final decision rests with the Buyer.

Article 6 — Right of Withdrawal Exception

Pursuant to Distance Contracts Regulation art. 15/1-ğ; "contracts relating to services performed instantly in electronic form or to intangible goods delivered instantly to the consumer" fall within the exceptions to the right of withdrawal. Since this service is digital content and an instantly performed SaaS service, the Buyer has no right of withdrawal.

The Buyer hereby acknowledges and declares that they were informed of this matter through the service agreement they accepted during registration, and that by requesting instant performance of the service they have waived the right of withdrawal.

Article 7 — Refund Policy

Notwithstanding the right-of-withdrawal exception, Bunayorumum accepts refunds under the following conditions as part of customer satisfaction:

  1. 1-hour rule: a full refund is provided within 1 hour from the time of payment, provided that no use whatsoever has been made of the purchased analysis package/credit.
  2. Defective service (TKHK art. 8): defective service covers situations such as the report not being produced at all due to a technical fault, or being delivered in a faulty/inaccessible form. The AI estimate not matching the Buyer's expectations, or the Buyer not agreeing with the report's outcome, does not by itself constitute a defect. Where the service is found to be defective, a pro-rata (per-day/per-use) refund is provided for the unused portion of the service.

Article 8 — Commercial Electronic Messages

Pursuant to Law No. 6563 and the İYS (Turkey's commercial-message management system) legislation; commercial electronic messages containing promotions, campaigns and informational content are sent only with the Buyer's prior consent. The Buyer may withdraw this consent free of charge at any time. Transactional notifications relating to the performance of the service are not within this scope.

Article 9 — Resolution of Disputes

In disputes arising from this Agreement, pursuant to the provisions of Consumer Protection Law No. 6502 (TKHK) art. 66-73, the Consumer Arbitration Committees at the Buyer's place of residence or at the place where the consumer transaction was carried out have jurisdiction within the monetary limits announced annually by the Ministry of Trade; for disputes exceeding these limits, the Consumer Courts have jurisdiction.

Article 10 — Entry into Force and Governing Law

This Agreement is subject to Turkish Law. When the Buyer completes the payment for the order they placed via the site, they are deemed to have accepted all the terms of this Agreement.
