Terms of Use

1. Scope and Acceptance

These Terms of Use (the "Terms") set out the conditions governing the use of the bunayorumum.net website and services (the "Service") provided by Bunayorumum (the "Company", "we"). By accessing or using the Service you are deemed to have accepted these Terms together with the KVKK Privacy Notice and the Cookie Policy.

If you do not accept these Terms, please do not use the Service.

2. Service Description and Purpose

Bunayorumum is an individual consumer research tool. Users use the Service to make an informed assessment of a car or a motorcycle they are considering buying. An AI-based analysis is performed on a single listing URL chosen by the user; the report may contain warning signals, negotiation points, a market comparison and summary verdicts.

When the vision analysis feature is enabled, a limited number of photos from the listing (up to 8) are run through an AI visual assessment for that analysis only; this processing is carried out on Anthropic (USA) infrastructure and raw photos are not stored permanently. This feature is conditional and is off by default.

The Service aims to protect consumer rights: it reduces the information asymmetry in the used car and motorcycle market and enables the consumer to make an informed decision. Uses outside this scope (bulk data extraction, commercial resale, developing a competing product, the use of bots/scripts for automated harvesting) are expressly prohibited and are detailed in Article 3.3.

3. Data Sources and Third-Party Platforms

The Service analyzes a publicly available listing URL chosen by the user. The listing data (vehicle attributes such as title, price, mileage, year, description and photo links) is retrieved from the relevant third-party platform at the user's request and, each time, for a single listing only.

For price comparison, the publicly available price, year and mileage information of comparable listings is compiled as anonymized and aggregate comparable (emsal) data. In this compilation no listing identity or seller information is stored; only the price distribution and the sample count are kept.

Bunayorumum:

• Does not perform bulk data extraction: each request is triggered for an individual consumer's own research.
• Does not store the listing owner's (seller's) personal data: fields such as phone number and full name are not recorded in our database. Only technical data relating to the vehicle itself is processed.
• Does not republish or sell listing content: analysis outputs are shown only to the relevant user.
• Has no partnership relationship with Sahibinden.com, arabam.com or similar listing platforms.
• If a written takedown/warning request relating to the scope of the Service is received from the relevant platforms, it is reviewed within 24 hours and, if necessary, access is restricted.

4. Account and User Obligations

4.1. Membership

• You must be 18 years of age or older to become a member.
• A person may open only one personal account.
• The information you provide when opening an account must be accurate and up to date.

4.2. Account Security

• It is your responsibility to keep your password confidential.
• You are responsible for all transactions carried out from your account.
• For your account security we recommend enabling two-factor authentication (2FA).
• If you suspect unauthorized access, contact us immediately.

4.3. Prohibited Conduct

The following conduct is expressly prohibited when using the Service and may lead to the immediate termination of your account:

• Accessing the Service with bots, scripts, crawlers, headless browsers or automated tools (e.g. using curl, wget, Selenium,Puppeteer)
• Reverse-engineering the API endpoints to call them directly or expose them to third parties
• Downloading, storing or republishing in bulk the listing data retrieved through the Service
• Using AI report outputs to resell them commercially, integrate them into another platform or develop a competing product
• Attempting to exceed quota limits by opening multiple accounts
• Going beyond normal consumer use by generating more than 50 analysis requests per hour or more than 200 per day
• Using the Service to harass, defraud or harm the listing owner (seller)
• Misusing the Service's infrastructure in a way that harms third-party platforms (such as Sahibinden.com)
• Sharing content that is unlawful, defamatory, misleading or that infringes the rights of others

These prohibitions aim to protect the user, the Company and the third-party platforms alike. When prohibited conduct is detected, the Company may suspend the account, pursue the relevant legal remedies and notify the competent authorities.

5. Informed User Consent

By using the Service you declare that you have read, understood and accepted the following clauses. You give this consent explicitly (via a checkbox) during registration; your subsequent use also means that you maintain this consent.

1. Nature of the AI output. I understand that the report I receive is generated by AI, does not replace an inspection/mechanical diagnosis, may contain erroneous or incomplete suggestions and is not investment/purchase advice.
2. Personal data processing. I know that, under the Turkish Personal Data Protection Law No. 6698 (KVKK), my personal data is processed as set out in the KVKK Privacy Notice, and that I have read the purposes, legal bases, retention periods and my rights relating to this processing.
3. Use of cookies. I understand that the site uses technical cookies, that I have read the Cookie Policy and that I will give separate consent for optional cookies.
4. Consumer purpose. I declare that I use the Service as an individual consumer and for my own vehicle research; and that I do not use it for the purpose of bulk data collection, commercial resale, developing a competing product or carrying out automated transactions on behalf of other people.
5. Automation ban. I undertake not to access the Service with bots, scripts or similar automated tools; not to resell the AI outputs commercially; and not to download them in bulk.
6. Third-party platforms. I understand that Bunayorumum is not an authorized distributor/representative of Sahibinden.com or similar platforms; that publicly available data is retrieved from these platforms for listing analysis; and that the relevant platform is responsible for the ultimate accuracy of the data.
7. Responsibility for decisions. I accept that all responsibilityfor the purchase, refraining-from-purchase, negotiation and other decisions I make based on the AI report I receive belongs to me; and that having an authorized inspection (ekspertiz) carried out for the vehicle's actual condition is my own obligation.

6. Subscription, Payment and Cancellation

6.1. Plans

The Service is offered with the following plans (for current prices and quotas see the /pricing page):

• Guest (unregistered): 1 trial analysis, free
• Free (registered): free, 5 member-only analyses (one-time)
• 30-Day Package: a one-time ₺349, 25 analyses over 30 days + advanced features (no auto-renewal)
• Premium: ₺599 per month, 60 analyses per month + all advanced features
• Dealer Starter / Pro / Enterprise: ₺1,999 / ₺4,499 / ₺9,999+, corporate and B2B packages
• Annual payment: 20% discount

6.2. Payment

• Active payment methods: bank transfer (Havale / EFT, by IBAN) and wallet balance. Bank transfer (Havale / EFT) payments are completed by manual approval (usually within about 1-24 hours).
• Credit / debit card payments will be offered soon. When enabled, card payments will be processed through a PCI-DSS-compliant third-party provider; card details are not stored on our servers.
• Wallet balance and gift cards: The wallet balance can be used only within the platform and cannot be converted to cash. A gift card is in the nature of a prepaid balance; promotional and invitation/referral credits are non-refundable.
• The Premium monthly subscription auto-renews at the start of each period; when the plan is changed, the change takes effect from the new period. The 30-Day Package does not auto-renew (it is a one-time purchase).
• The e-archive invoice / e-invoice relating to your payment is issued to the email address associated with your account.

6.3. Cancellation and Refund

• One-click cancellation: You can cancel your subscription at any time from the "Manage Subscription" menu in your dashboard, with no more burden than the step in which you registered (compliant with Consumer Protection Law No. 6502 (TKHK) and Article 20 of the Regulation on Subscription Agreements).
• On cancellation the Service remains active until the end of the current payment period; collection stops from the next period onward.
• Right of withdrawal: Since the 30-Day Package / Premium membership is in the nature of digital content performed instantly in an electronic medium, under Article 15/1-ğ of the Regulation on Distance Contracts the consumer's right of withdrawal cannot be used after the performance of the service has begun. During registration the user expressly confirms that they waive the right of withdrawal for the instantly performed digital service (Article 5).
• 1-hour goodwill refund: As part of customer satisfaction, a full refund is granted if the request is made within 1 hour from the moment payment is made and no analysis from the purchased package / subscription has been consumed. Request: destek@bunayorumum.net
• The consumer's claims on the grounds of defective service (e.g. a long-lasting service outage, failure to provide promised features) are reserved (TKHK Articles 13-15).

7. Content Rules

7.1. User Content

Your posts such as stories, comments, questions or reviews ("User Content") are your responsibility. Before publishing, make sure your post meets the following conditions:

• Does not infringe the rights of third parties (copyright, trademark, personality rights)
• Does not contain insults, discrimination or harassment
• Does not contain spam, advertising or misleading content
• Is lawful

7.2. Moderation and License of Use

We reserve the right to remove content that breaches the rules without prior notice.

For User Content you are deemed to have granted Bunayorumum a revocable, non-exclusive, royalty-free license of use under copyright law, to the extent necessary for providing, operating and reasonably improving the Service. This license:

• Is used only for operating and maintaining the Service
• Does not cover moral rights (Law on Intellectual and Artistic Works (FSEK) Articles 14-17: attribution of the name, the content not being altered)
• Cannot be used for commercial resale, AI training or sale to third parties
• When you delete the content, its display on the Service stops; it is cleared from existing copy/backup archives within a reasonable time

8. Intellectual Property Rights

The design, code, brand of the Service and the structure of the AI reports belong to Bunayorumum. You may view, save and share your reports for personal and non-commercial purposes. Bulk data extraction (data scraping), API reverse-engineering or use to develop a competing service is prohibited.

9. AI Output and Limitations of Liability

9.1. Nature of the AI Output

The reports provided as part of the Service are in the nature of generative AI output. The default text analysis is generated by Google Geminimodels (Google LLC); the "Deep Analysis" and the fallback that engages at times of high demand are generated by Claude models (Anthropic PBC). The data processing agreements made with these providers prohibit your data from being used for model training purposes. When vision (photo) analysis is enabled, photos are processed only on Anthropic infrastructure; no photos are transmitted to Google Gemini. These outputs:

• Do not replace an inspection, mechanical diagnosis or technical-check report
• Do not constitute investment, financial or purchase advice
• May contain erroneous, incomplete or out-of-date assessments
• Are based on the interpretation of statistically comparable listings; they do not cover independent findings specific to the particular vehicle

To learn the vehicle's actual technical condition you should turn to an authorized inspection (ekspertiz) and have an independent physical inspection carried out.

9.2. The Service Is Provided "As Is"

We do not warrant the following:

• The absolute accuracy, completeness or currency of the AI reports
• The accuracy or currency of the data retrieved from Sahibinden.com, arabam.com or similar listing platforms
• That the Service will operate uninterrupted, error-free or at a particular speed
• That a particular result will be achieved (e.g. finding a good vehicle, reaching an agreement with the seller)

9.3. Responsibility for Decisions

The user is responsible for all the consequences of the purchase, refraining-from-purchase, negotiation or other decisions you make based on the AI reports. The user has expressly accepted this point during registration and under Article 5 (Informed User Consent).

9.4. Liability Cap

To the maximum extent permitted by applicable laws, Bunayorumum's total liability for compensation towards the user is limited to the total amount the user actually paid for the Service in the 12 (twelve) months preceding the date on which the event giving rise to the loss occurred. This limit:

• Is without prejudice to cases of intent and gross faultand cases where liability cannot be limited in advance within the meaning of Article 115 of the Turkish Code of Obligations;
• Is without prejudice to the mandatory (non-waivable) statutory rights granted to the consumer under the Consumer Protection Law No. 6502;
• The commitments given to the user by reason of the nature of the product are out of scope.

These limitations apply only to the extent permitted by law; otherwise the relevant section is deemed void and the other provisions of the agreement remain valid (partial invalidity: TKHK Article 5/2 + Turkish Code of Obligations Article 27).

10. Account Suspension and Termination

We may suspend your account or terminate it permanently in the following cases:

• A clear breach of the Terms of Use
• Misusing the system or harming others
• Unlawful activity
• Non-payment of the subscription

You may also delete your account at any time. To delete your account, send a request to iletisim@bunayorumum.net.

11. Force Majeure

Bunayorumum cannot be held liable where the Service is not provided or is delayed due to a natural disaster, war, epidemic, government action, the collapse of internet infrastructure or other events beyond our control.

12. Dispute Resolution and Competent Court

These Terms are subject to the laws of the Republic of Türkiye.

12.1. Transactions Made as a Consumer

For individual users (consumers), Articles 73 and 68 of the Consumer Protection Law No. 6502 apply. These provisions are mandatory; they cannot be agreed otherwise by contract. Accordingly:

• For 2026, for disputes below TL 186,000, the Consumer Arbitration Committee at the consumer's domicile or at the Company's domicile is the competent body as the mandatory point of application.
• For disputes above this threshold, the Consumer Court has jurisdiction; where there is no such court, the Civil Court of First Instance acts in the capacity of a consumer court.
• Territorial jurisdiction: The consumer may also bring an action in the court of their own domicile (TKHK Article 73/5). A contractual term restricting this right does not apply.

12.2. Transactions Made as a Merchant (Dealer / Professionals)

For commercial use (the Dealer/Professionals plan or corporate subscriptions), the Istanbul Courts and Enforcement Offices have jurisdiction.

12.3. Alternative Dispute Resolution

Before resorting to legal remedies, contacting us at iletisim@bunayorumum.nethelps reach a quick resolution in most cases.

13. Changes to the Terms

13.1. Notice Period

We may update these Terms over time. We notify significant changes that may be to the consumer's disadvantage at least 15 (fifteen) days before they take effect, through the following channels:

• A notification to the email address associated with your account
• A prominent notice within the site (the login page or a dashboard banner)
• The effective date and a summary list of the changes

Corrections that are not to the consumer's disadvantage, typos, page-layout improvements and technical clarifications may be updated without a notice period.

13.2. Right to Reject and Terminate Free of Charge

A user who does not wish to accept the notified changes may terminate their account free of charge before the effective date. In that case:

• If there is a payment period already paid, the Service remains active until the end of that period;
• No collection is made for the next period;
• The user's statutory rights of withdrawal and refund (TKHK Articles 11, 48, etc.) are reserved.

Continuing to use the Service after the effective date means that you accept the new Terms.

13.3. Version Archive
